1. Nature of Services

OASS provides non-emergency home care services, including but not limited to:

• Professional nursing and medical assistance at home.

• Companionship, time-spending, and morning walk assistance.

• General house help and domestic assistance for elders.

• Dietary management and medicine administration tracking.

Important: OASS is a home-care service provider and not a hospital or emergency medical response unit. In the event of a life-threatening emergency, please contact local emergency services or your primary hospital immediately.

2. Service Agreement & Booking

• Assessment: All services begin with a mandatory assessment of the elder’s health and requirements.

• Plans: Services are provided based on the specific “Care Plan” selected (e.g., 8-hour, 12-hour, or 24-hour shifts).

• Documentation: Clients must provide accurate medical history and emergency contact details before the commencement of service.

3. Payment Terms

• Invoicing: Services are billed in advance (monthly or weekly as per the agreement).

• Taxes: All prices are subject to applicable GST as per Indian Government regulations.

• Delayed Payment: Failure to pay on time may result in a temporary suspension of services.

4. Cancellation & Refund Policy

• Notice Period: To cancel or pause a service, a minimum notice of 48 hours is required.

• Refunds: Refunds for unused service days (in case of hospitalization or travel) will be processed on a pro-rata basis, subject to a small administrative fee.

5. Staff Conduct and Safety

• Mutual Respect: We maintain a zero-tolerance policy for abuse or harassment of our staff (nurses/helpers) by clients or their families.

• Poaching Policy: Clients agree not to hire any OASS staff member privately or outside the OASS contract for a period of 1 months after the termination of the service.

• Safety: The client must ensure a safe and hygienic working environment for our caregivers within the home.

6. Medical Disclaimer & Liability

• Clinical Outcomes: While our nurses are certified professionals, OASS does not guarantee specific health outcomes as recovery depends on multiple biological and medical factors.

• Medication: OASS staff will only administer medications prescribed by a registered medical practitioner.

• Limitation of Liability: OASS is not liable for any incidents resulting from undisclosed medical conditions or if the family ignores the professional advice of our caregivers.

7. Termination of Service

Either party may terminate the service agreement by giving 7 days written notice. OASS reserves the right to terminate the service immediately in cases of non-payment or safety concerns for our staff.

8. Confidentiality

OASS will maintain strict confidentiality regarding the client’s medical records and personal life, as detailed in our Privacy Policy.

9. Governing Law

These terms are governed by and construed in accordance with the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of the courts in Ghaziabad, Uttar Pradesh
